Terms of Service

These Terms of Service govern your use of backup sump pump installation, maintenance, and repair services provided by AquaGuard Pro throughout Canada.

1. Service Agreement

By requesting or accepting our services, you agree to these terms. Services are performed in accordance with Canadian building codes, provincial regulations, and manufacturer specifications for backup sump pump systems.

2. Services Provided

AquaGuard Pro offers the following services across Canada:

• Backup sump pump system installation with battery power backup
• Primary sump pump installation and replacement
• Annual maintenance and inspection programs
• Emergency repair services (24/7 availability in select regions)
• Battery replacement and testing services
• System upgrades and modifications
• Warranty service and support

3. Pricing and Payment Terms

Service pricing is based on:

• Equipment selected and installation complexity
• Geographic location within Canada

7. Limitation of Liability

AquaGuard Pro is not liable for:

• Damage resulting from failure to maintain the system as recommended
• Consequential damages (property damage, lost items, business interruption)
• Acts of nature, power grid failures, or municipal water system issues

Our maximum liability is limited to the amount paid for the specific service in question.

8. Service Area

We provide services throughout Canada. Availability of emergency services may vary by region. Remote areas may be subject to additional travel charges.

9. Dispute Resolution

Any disputes will be resolved through good faith negotiation. If resolution cannot be reached, disputes will be settled through binding arbitration in accordance with the laws of the province where services were provided.

Refund Policy

AquaGuard Pro is committed to customer satisfaction. This policy outlines our refund and service guarantee terms for backup sump pump services in Canada.

1. Service Satisfaction Guarantee

We stand behind the quality of our work. If you are not satisfied with our installation or service, please notify us within 7 calendar days of service completion. We will assess the issue and work with you to resolve any legitimate concerns.

2. Installation Service Refunds

Refund eligibility for installation services:

• Full Refund: If installation cannot be completed due to our inability to provide the service (wrong equipment, lack of technician availability, etc.)
• Partial Refund: If the system fails within 30 days due to installation defects, we will first attempt to correct the issue at no charge. If correction is not possible, a partial refund may be provided based on the specific circumstances.
• No Refund: After system acceptance and successful operation, labor charges are non-refundable. Issues arising from customer negligence, misuse, or external factors are not eligible for refunds.

3. Equipment Returns and Refunds

Equipment purchased through AquaGuard Pro:

• Unopened Equipment: May be returned within 14 days for a refund minus a 20% restocking fee
• Installed Equipment: Cannot be returned once installed. Equipment defects are covered under manufacturer warranty, not refund policy.
• Wrong Equipment Ordered: If we provide incorrect equipment, we will exchange it at no cost to you

4. Service Call Fees

Diagnostic and service call fees are non-refundable once a technician has been dispatched to your property, even if you decide not to proceed with recommended repairs.

5. Emergency Service Charges

Emergency after-hours service fees are non-refundable due to the priority response nature. If the issue cannot be resolved immediately, the emergency fee covers the initial response, and additional repair costs will be quoted separately.

6. Maintenance Plan Refunds

Annual maintenance plans:

• May be cancelled within 30 days for a full refund if no services have been performed
• After 30 days, refunds are provided on a pro-rated basis for unused months
• If annual service has been completed, no refund is available for that contract year

7. Warranty Work

Repairs covered under warranty are performed at no charge. Warranty work does not qualify for refunds as there is no charge for the service.

8. Refund Processing

Approved refunds will be processed within 10-14 business days to the original payment method. You will receive email confirmation once the refund has been initiated.

9. Exceptions and Special Circumstances

Each situation is unique. If you believe you have an exceptional circumstance not covered by this policy, please contact our customer service team. We will review your case individually and make fair determinations.
